Home Health Care Software LLC (“Allcare”) is committed to maintaining robust privacy practices for its users.

 This privacy statement (this “Privacy Statement”) summarizes ALLCARE practices with respect to the privacy of users of ALLCARE website (the “Website”) or ALLCARE applications (the “Applications”). From time to time, this Privacy Statement is subject to change. For example, as we update and improve our products and services, new features may require modifications to this Privacy Statement.

 What is personally identifiable information?

“Personally identifiable information” is any data that could potentially be used to identify a particular person, such as a person’s name, address, e-mail, user ID, social security number, etcetera.

 How is information collected, used, and disclosed?

We may request that you voluntarily supply information within the Applications in order to provide services or to enhance your experience. Providing this information is up to you, however if you choose to do so, it must be sent in an encrypted fashion that sufficiently protects PHI/PII. Mechanisms to send data securely vary depending on the sender’s electronic mail system, network and system configuration, etcetera, and are the responsibility of the sender. We do not collect any personally identifiable information without your consent.

ALLCARE is a Business Associate performing services on behalf of Covered Entities. As such, your PII may be provided to ALLCARE in order for ALLCARE to provide the appropriate services in accordance with contractual obligations to our customers. Requests for updates or deletion of PII must be coordinated through the Covered Entity that collected the information, as such requests may impair ALLCARE ability to provide agreed-upon services.

If you have voluntarily provided information, you consented to the collection and use of your personally identifiable information as described in this Privacy Statement. In some circumstances, ALLCARE may share information you voluntarily provide us with trustworthy business partners. We do not sell or rent personal information collected through the Applications. ALLCARE may also provide certain statistics about site visitors, including volume, traffic patterns, and related site information to reputable third-party vendors, but these statistics will not include any personally identifiable information.

ALLCARE may also disclose personally identifiable information in special cases when we have a good faith belief that such disclosure is necessary to: (a) comply with legal requirements; (b) defend and protect company property; (c) enforce Terms and Conditions of Use of the Applications; or (d) protect the interests of our users or others.

The app does use third-party services that may collect information used to identify you.

 Visiting the Site from outside the U.S.

The Applications are operated in the United States. This Privacy Statement is intended to cover the collection of information within the Applications from United States residents only. If you are located outside of the United States, please be aware that any information you provide to us will be transferred to the United States. By using the Applications, participating in any of our services and/or otherwise providing us with your information, you understand and agree that your information may be moved to, accumulated and processed in the United States where our servers are located and our central database is operated and such information may be transferred to our third parties with whom we share such information as described in this Privacy Statement.

 Children’s Policy

The Applications are restricted to individuals eighteen (18) years of age and older. The Applications are not designed for or targeted at children. No one under the age of thirteen (13) may provide any information on the Website, within our applications. While our applications might be used in connection with services provided to minors, an adult guardian is responsible for entering any appropriate information into the Application. We do not knowingly collect and maintain information from children under the age of thirteen (13). If we are informed that a user is under the age of thirteen (13), we will immediately close that user’s account and delete such information. Should you know that a user is under the age of thirteen (13), please contact us immediately.

 How do we protect your information?

We are painstaking in our efforts to protect your personally identifiable information. ALLCARE has security measures in place to protect the loss, misuse, and alteration of the information under ALLCARE control. ALLCARE employs strict security measures to safeguard personally identifiable information. This includes, among other things, using firewalls, encryption, intrusion detection and site monitoring. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure, so despite our efforts, we cannot ensure or warrant the security of any information you transmit to us or receive from us. Internally, we will restrict access to your personally identifiable information to employees who need access to the information to do their jobs. These employees are committed to our privacy policies.

As a provider of services to the healthcare industry, ALLCARE has implemented programs to address the transaction standards, and the privacy and security implications of the rules promulgated pursuant to the Health Insurance Portability and Accountability Act of 1996 with respect to protected health information.

 How can you help protect your information?

If you are using the Applications for which you registered and created a password, we recommend that you never divulge your password to anyone. We will never ask you for your password in an unsolicited manner. Also remember to sign out of the registered site and close your browser window when you have finished working. This is to ensure that others cannot access your personal information and correspondence if others have access to your computer.

 What are cookies and how are they used?

The Website, like most other commercial websites, may utilize a standard technology called “cookies” to collect information about how our site is used. Cookies help a website operator determine that a user had visited the site previously and save and remember any preferences that may have been set by the user while browsing the site. Cookies cannot retrieve any other data from your computer’s hard drive or obtain your e-mail address. If you are simply browsing an ALLCARE informational website, a cookie may be used to identify your browser as one that has visited the site before.

We may also make use of memory-based cookies in support of authenticating the user of the Applications. Similarly, if you are a registered user of a site providing service to ALLCARE clients (and have a user ID and password), we may use cookies so that we can provide personalized information based on preferences you have indicated while using the site. Although you can modify your browser to either accept or reject all cookies, it may not be possible to utilize ALLCARE services which require registration if you reject cookies.

Right to Deletion 
Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:
  • Delete your personal information from our records; and
  • Direct any service providers to delete your personal information from their records.
Please note that we may not be able to comply with requests to delete your personal information if it is necessary to:
  • Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;
  • Debug to identify and repair errors that impair existing intended functionality;
  • Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent;
  • Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;
  • Comply with an existing legal obligation; or
  • Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.
What are your choices regarding the collection, use, and distribution of your information?

If you have voluntarily provided information, you consented to the collection and use of your personally identifiable information as described in this Privacy Statement.

If you have voluntarily provided personally identifiable information, we may send you mail or e-mail regarding products and services. If you do not want to receive such offers and mailings, you can indicate that by checking the appropriate box on the submission form.

All Care collects personal information on individuals only as allowed by law and uses personal information only as specified and consistent with those purposes; unless All Care obtains the consent of the subject of the information, or as required or allowed by law. Any subsequent use of the information shall be limited to and consistent with the fulfillment of those purposes; and/or to make disclosures as required or authorized by law.

  To comply with Federal and State Laws, All Care may collect the following information as well as additional information as necessary:

  1. Location information includes GPS latitude and longitude at the start and end of a visit. Location is ONLY collected at these two points in time. All Care does not track the movement of the users at any time.
  2. Start and end date and time of the visit
  3. Hours worked
  4. Provider identification
  5. Recipient identification
  6. Language preference
  7. Device model/version

Provided there is no cellular or Wi-Fi signal, the All Care EVV Mobile App may store the above referenced information on a mobile device temporarily (in an encrypted form). Once a signal is established, such data is transferred to All Care system and then deleted from the device.

How can you correct, access, and update your information?

Log Data

We want to inform you that whenever you use our Service, in a case of an error in the app we collect data and information (through third-party products) on your phone called Log Data. This Log Data may include information such as your device Internet Protocol (“IP”) address, device name, operating system version, the configuration of the app when utilizing our Service, the time and date of your use of the Service, and other statistics.

Changes to This Privacy Policy

We may update our Privacy Policy from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Privacy Policy on this page.
